Welcome to KLM Pool Care. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Services Provided
KLM Pool Care provides pool maintenance, cleaning, repair, and related services (collectively, the "Services"). Our Services include, but are not limited to:

2.1. Contract Terms. All Services are provided pursuant to a service agreement between you ("Client" or "you") and KLM Pool Care. Service agreements may be for one-time services, recurring maintenance, or seasonal contracts.
2.2. Payment Terms. Payment for Services is due as specified in your service agreement. Unless otherwise stated, payment is due upon completion of service or monthly in arrears for recurring maintenance contracts. We accept credit cards, checks, and electronic payments.
2.3. Late Payments. If payment is not received within 30 days of the invoice date, we reserve the right to charge a late fee of 1.5% per month on the outstanding balance or the maximum rate permitted by law, whichever is less. Services may be suspended for accounts more than 60 days past due.
2.4. Cancellation. You may cancel recurring services with 30 days' written notice. Cancellation of one-time services must be made at least 48 hours in advance to avoid a cancellation fee equal to 50% of the scheduled service cost.
3. Client Responsibilities
3.1. Access. You must provide safe and unobstructed access to your pool and related equipment during scheduled service times. If our technicians cannot access your property, you may be charged a trip fee.
3.2. Accuracy of Information. You agree to provide accurate information about your pool, equipment, and any special conditions or requirements. You must notify us immediately of any changes that may affect our Services.
3.3. Safety. You are responsible for ensuring that all persons on your property, including children and pets, are kept at a safe distance during service calls. You must inform us of any known hazards on your property.
3.4. Equipment Maintenance. While we provide maintenance services, you remain responsible for the overall condition and safety of your pool and equipment. You should follow all manufacturer recommendations for equipment care.
4. Warranties and Guarantees
4.1. Service Quality. We guarantee that all Services will be performed in a professional and workmanlike manner. If you are not satisfied with our work, you must notify us within 48 hours, and we will re-perform the service at no additional charge.
4.2. Parts and Equipment. Replacement parts and equipment supplied by KLM Pool Care are warranted according to the manufacturer's warranty. We do not provide additional warranties beyond those provided by manufacturers.
4.3. No Guarantee of Results. While we strive to maintain your pool in optimal condition, we cannot guarantee specific results due to factors beyond our control, including weather, usage patterns, and pre-existing conditions.
5. Limitation of Liability
5.1. Service Limitations. KLM Pool Care's liability for any claim arising from or related to our Services is limited to the amount paid by you for the specific service giving rise to the claim.
5.2. Excluded Damages. In no event shall KLM Pool Care be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of use, or property damage not directly caused by our negligence.
5.3. Pre-Existing Conditions. We are not responsible for damage caused by pre-existing defects, faulty installation by others, normal wear and tear, or damage resulting from your failure to follow our maintenance recommendations.
5.4. Acts of God. KLM Pool Care is not liable for any failure to perform Services or any damage resulting from weather events, natural disasters, or other circumstances beyond our reasonable control.
6. Insurance and Indemnification
6.1. Our Insurance. KLM Pool Care maintains general liability insurance. Proof of insurance is available upon request.
6.2. Client Indemnification. You agree to indemnify and hold harmless KLM Pool Care, its employees, and agents from any claims, damages, or expenses arising from your breach of these Terms or your negligent acts or omissions.
7. Intellectual Property
All content on the KLM Pool Care website, including text, graphics, logos, images, and software, is the property of KLM Pool Care or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.
8. Privacy
Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.
9. SMS Communications
9.1. Consent to Receive SMS. By providing your mobile phone number to KLM Pool Care, you expressly consent to receive text messages (SMS) from us regarding appointment reminders, service updates, promotional offers, and other communications related to our Services. Message frequency may vary.
9.2. Message and Data Rates. Message and data rates may apply. Standard text messaging rates from your wireless carrier will apply to all SMS messages sent and received. You are responsible for all charges from your wireless provider.
9.3. Opt-Out. You may opt out of receiving SMS messages at any time by replying “STOP” to any text message from us or by contacting us directly. You may also text “HELP” for assistance. After opting out, you will receive a confirmation message, and no further messages will be sent unless you re-subscribe.
9.4. Phone Number Updates. You agree to notify us immediately if you change your mobile phone number or if the number is reassigned to another person. We are not responsible for messages sent to a phone number you no longer control.
9.5. No Liability for Delayed or Undelivered Messages. KLM Pool Care is not liable for delayed or undelivered SMS messages. Delivery of messages may be affected by factors outside our control, including wireless carrier coverage, network congestion, and mobile device settings.
9.6. Compatible Carriers. SMS messages are compatible with most major wireless carriers in the United States. If you experience issues receiving messages, please contact your carrier or reach out to us for alternative communication methods.
10. Dispute Resolution
10.1. Informal Resolution. Before filing any formal claim, you agree to contact us to attempt to resolve the dispute informally. You can contact us at the information provided on our website.
10.2. Arbitration. Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the jurisdiction where the Services were performed.
10.3. Class Action Waiver. You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, and you waive your right to participate in any class action against KLM Pool Care.
11. Termination
We reserve the right to terminate or suspend your access to our Services immediately, without prior notice, for any breach of these Terms or for any other reason at our sole discretion. Upon termination, your right to use our Services will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which our Services are provided, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the jurisdiction where Services were performed.
13. Changes to Terms

14. Severability
